With the heated discussions about non-compete, non-solicitation and don’t join competitors’ arguments flying around, here is my suggestion.

To companies: Pay your leaving employee for the duration of restrictions and I am sure no employee will have an issue. You want people to get selective about jobs and not join competitor then compensate them for it.

To prospective employee: I know companies will not do it. But next time you see this clause, ask them to compensate for that time and then you will know what kind of company you are about to join. If you don’t like the answer, consider it a major red flag and avoid joining the firms or join with caution in case you don’t have an option.
